Terms of Service

These Terms of Service (“Terms”) govern your use of TIPPA, a waste transfer duty-of-care record-keeping application provided by JPH Ltd (“TIPPA”, “we”, “us”). By creating an account or using TIPPA, you agree to these Terms on behalf of yourself and, if you are creating an organisation, on behalf of that organisation.

1. What TIPPA is — and isn’t

TIPPA helps your organisation record waste transfer receipts, manage sites, and keep track of carriers, brokers, and waste transfer documentation. TIPPA is a record-keeping tool, not a substitute for your own legal duty of care under UK waste regulations. You (or your organisation) remain solely responsible for complying with all applicable waste, environmental, health and safety, and data protection law, and for the accuracy of any information you enter into TIPPA. Where TIPPA submits information to Defra’s Digital Waste Tracking service on your behalf, that submission is made using data you have provided and reviewed — we do not independently verify its accuracy or your regulatory compliance.

2. Accounts and organisations

Each user belongs to one organisation. An organisation’s administrator(s) can invite additional members and control their access. You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account. Your organisation’s administrator is responsible for who they invite and what access those members are given.

3. Subscriptions and billing

Some features, and more sites, vehicles or office users than the free allowance, need a paid subscription. Subscriptions are bought by an organisation administrator in TIPPA’s web app, not in the iPhone or Android apps. Our orders are processed by Paddle.com, our online reseller and the merchant of record, which handles payment, VAT and invoices; Paddle’s buyer terms also apply to your purchase. Prices are shown before VAT and billed monthly, and subscriptions renew automatically until cancelled. A change to your subscription is charged or credited straight away, in proportion to the time left in the month. You can cancel at any time from Manage Subscriptions: what you’ve paid for stays until the end of that month and isn’t renewed.

Refunds: if you change your mind about a new subscription, you can ask for a full refund of its first payment within 14 days of that payment. Later payments (monthly renewals, and charges for adding to an existing subscription) aren’t refunded, and cancelling stops future payments rather than refunding the current month. If we’ve charged you by mistake (for example twice, or after you cancelled), tell us within 60 days and we’ll refund the charge in full. To ask for a refund, use the link in your Paddle receipt email or contact us at support@tip-pa.co.uk. Refunds are made through Paddle, to the payment method you paid with. None of this affects any rights you have under the law.

Your organisation retains ownership of the data it enters into TIPPA (sites, customers, waste transfer receipts, and related records). We process that data as described in our Privacy Policy, including on your organisation’s behalf as a data processor for personal data about your carriers, brokers, and other contacts that you enter.

6. Availability and disclaimers

We aim to keep TIPPA available and reliable but do not guarantee uninterrupted or error-free operation. TIPPA is provided “as is” without warranties of any kind, to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for any regulatory fine, penalty, or enforcement action arising from your organisation’s use of TIPPA or the accuracy of data you or your organisation’s members have entered.

8. Ending your account

You may delete your account, or an administrator may delete their organisation and its data, at any time from Settings. Waste transfer receipts are retained for a period after deletion in line with UK waste duty of care record-keeping requirements, even where the rest of an organisation’s data is deleted — see our Privacy Policy for details. We may suspend or terminate an account that breaches these Terms.

9. Changes to these Terms

We may update these Terms from time to time. We will let you know of material changes (for example, by email or an in-app notice) before they take effect.

10. Governing law

These Terms are governed by the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
